Board of Adjustment and Appeals

The Board of Adjustment and Appeals hears and decides:

• appeals from the final determinations or final orders of Borough officials regarding alleged errors in enforcement or application of platting special land use, or zoning ordinances unless a different appellate procedure is provided for by this code.
• appeals from decision of the Planning Commission on requests for conditional uses, variances, and other quasi-judicial zoning and land use determinations made by the Planning Commission pursuant to Title 17.
• appeals from decisions of the Platting Board regarding preliminary plats, variances, waivers, dedications, vacations, and other quasi-judicial determinations made pursuant to Title 43.
• appeals from decisions of the Manager pursuant to MSB 8.50.

Appeals of the Board of Adjustment and Appeals are conducted pursuant to MSB 15.39.
