Encroachment Reimbursement Fee
If the Borough must remove an unauthorized encroachment from Borough property, a public right-of-way, or an easement, the person responsible for the encroachment may be required to reimburse the Borough for the cost of that work. Unauthorized encroachments can include structures, improvements, equipment, materials, or other items placed on Borough property without approval.
In many cases, the Borough will first notify the property owner or responsible party and provide an opportunity to remove the encroachment. If it is not removed within the required timeframe, the Borough may perform the work and bill the responsible party for all costs associated with the removal. Unauthorized encroachments are considered a public nuisance and may be subject to additional enforcement actions.
For more information, see MSB Code § 11.10.030, Unauthorized Encroachments.
