Tall Structure Permit
Permit Types
There are three types of permits for tall structures:
1. Administrative Permit
- For towers between 85 and 125 feet
- Requires site plan, FAA clearance, and design drawings
- Fee: $500
2. Conditional Use Permit (CUP)
- For towers over 125 feet
- Requires a community meeting and detailed citizen participation report
- Fee: $1,500
3. Network Improvement Permit
- For modifications to existing towers
- Fee: $100
How to Apply
Apply online through the Borough’s permitting portal:
You’ll need:
- Completed application form
- Site plan certified per MSB 17.125.010
- FAA “no hazard” determination
- Design drawings certified by an engineer or architect
- For CUP: Citizen participation report and community meeting summary
Before the public hearing, applicants must also pay advertising and mailing fees.
Operation Standards
All tall structures must:
- Meet setback requirements under MSB 17.55
- Provide emergency vehicle access and parking
- Post identification and emergency contact signage
- Include fencing and safety warnings if applicable
- Follow additional standards for wind energy systems (WECS)
