Tall Structure Permit

Permit Types

There are three types of permits for tall structures:

1. Administrative Permit

  • For towers between 85 and 125 feet
  • Requires site plan, FAA clearance, and design drawings
  • Fee: $500

2. Conditional Use Permit (CUP)

  • For towers over 125 feet
  • Requires a community meeting and detailed citizen participation report
  • Fee: $1,500

3. Network Improvement Permit

  • For modifications to existing towers
  • Fee: $100

How to Apply

Apply online through the Borough’s permitting portal:

You’ll need:

  • Completed application form
  • Site plan certified per MSB 17.125.010
  • FAA “no hazard” determination
  • Design drawings certified by an engineer or architect
  • For CUP: Citizen participation report and community meeting summary

Before the public hearing, applicants must also pay advertising and mailing fees.


Operation Standards

All tall structures must:

  • Meet setback requirements under MSB 17.55
  • Provide emergency vehicle access and parking
  • Post identification and emergency contact signage
  • Include fencing and safety warnings if applicable
  • Follow additional standards for wind energy systems (WECS)
